Terms of Service

1. Overview

dzbot is software designed to help users manage and organize DayZ Game Servers. By using this Service, you confirm that you have the right and permission to manage the servers you connect through the Service.

2. User Accounts and Registration

To use dzbot, you must create an account by connecting your Discord and Nitrado accounts via OAuth2. We do not handle passwords; authentication is managed by Discord and Nitrado. Through Discord and Nitrado we access your Discord username and email address. When you use the platform, we also process technical data such as your IP address and device identifiers for security and abuse prevention, as described in our Privacy Policy. By using our Service, you agree that:

• You are responsible for ensuring that your server usage complies with the server owner's permission.
• You will not share your Discord or Nitrado credentials with unauthorized third parties.

3. User Responsibilities and Content

Users may share content related to server management, provided it is appropriate and in compliance with these Terms. You agree that you will:

• Only manage servers to which you have authorized access.
• Not upload, post, or share any explicit, illegal, or inappropriate content.
• Respect other users and refrain from using the platform for malicious activities.
• Not create or operate multiple accounts to gain an unfair advantage, and not attempt to circumvent a ban, suspension, or other enforcement action (for example by registering a new account).

dzbot reserves the right to remove any content that violates these Terms without prior notice.

To protect the integrity of the platform, we may use technical signals such as IP address, device identifiers, and browser characteristics to detect multiple accounts and ban circumvention, as described in our Privacy Policy. Accounts found to be operating in violation may be suspended or terminated under Section 7.

4. Payments and Subscription

dzbot uses a single subscription model that unlocks all features while the subscription is active, except for usage of the AI Companion beyond the included amount (see below). The subscription is billed monthly, and users can cancel at any time. Refunds are issued for unused days remaining in the current billing period if you are not satisfied with our Service. We do not provide refunds for days that have already passed.

Trial period

Your servers in dzbot belong to an organisation — the account group that owns them and is billed for them. A new organisation may try dzbot free of charge for up to 14 days from the day it is created, to evaluate the Service. The trial is granted once per organisation and covers the servers it connects during that time; servers added later have no trial. No payment details are needed to start. Paying for a server ends the trial for that server: its paid subscription starts and is charged immediately, and its remaining trial days lapse. Other servers of the organisation keep their trial until it ends. Unused trial days are not paid out or carried over, and an organisation receives no second trial.

When a server has neither trial nor paid time left, dzbot pauses it: the admin area, the shop, the public pages, Discord commands and all automations stop, and the mod files dzbot wrote to the game server are reverted to their originals once. Data is kept and game-server logs continue to be imported. After payment everything resumes; mod files are transferred again at the next server restart.

AI Companion credit

Usage of the AI Companion is paid from an AI credit balance held by the organisation. Every organisation with an active subscription receives €1 of included credit each billing month, and an organisation in its trial receives €1 once for the trial; unused included credit does not carry over. Beyond that, the organisation can buy prepaid credit. Usage is charged in euros after each request; the price of a request depends on its size and is shown in the dashboard. If a request costs more than the remaining balance, the balance ends at zero and dzbot covers the difference; further requests are declined until credit is added.

Purchased credit does not expire and stays with the organisation, also when it temporarily has no server. Credit cannot be transferred to another organisation, is not refunded and is not paid out. Because the credit is available immediately, you agree at checkout that dzbot starts providing it right away and that you thereby lose your statutory right of withdrawal.

5. Intellectual Property

While the DayZ trademark belongs to Bohemia Interactive, dzbot protects all content generated by users on our platform. Users grant us the rights to use, display, and distribute their content for the operation of the Service. We will pursue legal action against any attempts to scrape or misuse user-generated content for external purposes.

6. Limitation of Liability

dzbot aims to provide a reliable service but is not liable for the following:

• Data loss caused by system errors or server issues beyond our control.
• Refund claims for temporary service interruptions or downtimes.
• Any third-party links or services accessed through our platform, including Discord or Nitrado APIs.

Users are encouraged to report service-related issues via our Discord, but we do not guarantee compensation for any inconvenience.

7. Termination of Service

dzbot reserves the right to terminate accounts that violate these Terms at any time. A server whose Nitrado connection has been lost and that has no active subscription is deleted together with its data 30 days after the connection was lost; a paused server whose connection still works is not deleted. Upon termination, user-generated content may be retained indefinitely for potential account recovery. Users who wish to delete their data can contact us as outlined in our Privacy Policy.

8. Privacy and Data Protection

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data.

9. Governing Law

These Terms will be governed by and construed in accordance with the laws of Germany. Any legal disputes will be handled in the court of Oldenburg, Germany.

10. Dispute Resolution

All disputes regarding the Service will be managed internally by dzbot. By using our Service, you agree to waive your right to participate in any class action lawsuit against dzbot.

11. Changes to These Terms

dzbot reserves the right to modify these Terms at any time. Any changes will be posted on this page and announced in our Discord community. Continued use of the Service after such changes are published constitutes acceptance of the revised Terms.

12. Third-Party Services and Force Majeure

dzbot relies on the APIs of Discord and Nitrado for its functionality. Outages or issues with these services are considered force majeure, and dzbot is not liable for disruptions caused by such external service providers. Users will be informed of outages via our Discord channel.

13. Right of Withdrawal for Consumers

This section applies if you use the Service as a consumer, i.e. for purposes that are outside your trade, business or profession. For AI Companion credit, the right of withdrawal ends as described in Section 4.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (dzbot, Patrick Siemen, Böckstiegelstr. 17, 33649 Bielefeld, Germany, e-mail: info[nospam]@dzbot.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.
